Ireland’s Gender Recognition Act 2015 arose from a long-running legal challenge by Dr Lydia Foy. In Foy v An tArd-Chláraitheoir and Others [2007] IEHC 470, Mr Justice Liam McKechnie held that the absence of a legal route by which a transgender person could obtain recognition of their acquired sex was incompatible with Article 8 of the European Convention on Human Rights. The High Court made a declaration of incompatibility under the European Convention on Human Rights Act 2003. That declaration did not itself change Irish law; legislating remained a matter for the Oireachtas.

The National Gender Service and the HSE model of care

How does the HSE treat adults and minors with gender distress, and what is the dispute over the model of care?

Ireland’s public provision for people experiencing gender distress has developed unevenly. Adults can be referred to the National Gender Service, while services for children and adolescents have historically involved GPs, local primary-care services, CAMHS, paediatric endocrinology at Children’s Health Ireland (CHI), and referrals abroad. The result is not a single, published and fully operational national pathway covering every age group.

How were Irish children referred abroad for treatment, what did the Tavistock closure mean for Ireland, and what happens now?

Ireland did not have a dedicated multidisciplinary public gender-identity service for children and adolescents when referrals to England began. The National Gender Service at St Columcille’s Hospital, Loughlinstown, was an adult service. For younger patients, the route described in the HSE’s 2023 review was through general practice, CAMHS and/or paediatric endocrinology at Children’s Health Ireland, with specialist psychological or psychiatric assessment sought from the Tavistock and Portman NHS Foundation Trust in London.

What guidance do Irish schools follow on gender-questioning pupils, and what are parents told?

Irish schools are required to prevent bullying, including bullying connected with gender identity. They are not, however, governed by a single current Department of Education protocol setting out when or whether a pupil should socially transition at school, whether parents must be informed, or how competing interests should be resolved. The practical position is instead shaped by a mixture of compulsory anti-bullying procedures, an older Department-hosted post-primary resource, local school policies, child-protection duties and professional judgement.

What has the Irish government proposed on conversion practices, and would it cover exploratory therapy?

Ireland does not, as of September 2026, have an enacted statute specifically prohibiting “conversion therapy” or “conversion practices”. The Government’s stated policy is to introduce one. The relevant proposed Government measure is generally called the Prohibition of Conversion Practices Bill , but no published Heads of Bill or full Bill text has yet set out its operative definitions, defences, offences, evidential thresholds or sanctions.

Ireland’s legal framework does not contain one bespoke statute governing every women-only changing room, refuge, toilet, sports team or school activity. Detransition is not a single clinical outcome. Crucially, detransition is not synonymous with regret; equally, regret cannot be assumed absent merely because a patient remains in a transition pathway.

“Therapist” is not a single regulated title in Ireland.
